1. ACCOUNT REGISTRATION & AUTHENTICATION
1.1 Creating an Account
To make purchases on CrowCrowCrow, you must create an account by providing:

CrowCrowCrow uses a One-Time Password (OTP) system for secure account access:

1.5 Account Suspension or Termination

Business Model Disclosure
CrowCrowCrow operates as a merchant importer and reseller. We import products from international markets and sell them to you as domestic transactions within India.
Important: CrowCrowCrow (operated by Color Papers India Private Limited) is NOT the manufacturer or authorised brand owner of any product listed on this platform. We are an independent importer and reseller. Products are directly procured from the USA market as per availability and listed on our website with transparent pricing that includes product cost, international shipping, customs charges, last-mile delivery charges, and our margins.
How Our Business Model Works:

Customs Clearance Process
- •All customs duties, import taxes, and IGST are included in your order price
- •You will NOT receive any separate customs bills or duties at delivery
- •We submit our Import Export Code (IEC) and GST Certificate (GSTIN) to customs authorities
- •All clearance documentation, regulatory filings, and BIS compliance paperwork is handled by us
- •We pay all customs duties, IGST, and applicable charges on your behalf
- •All legal compliance obligations — including product safety, BIS certification requirements, and import liability — remain with Color Papers India Pvt Ltd as the importer of record (IEC holder)
- •Import documents (Bill of Entry, customs receipts) belong to Color Papers India Pvt Ltd
- •You will NOT receive import documents as this is a domestic sale
Invoice & Billing
- •You will receive a GST-compliant sales invoice from Color Papers India Private Limited for every order
- •The invoice will contain: product details, quantity, unit price, applicable GST (CGST/SGST or IGST), total amount, and our GSTIN
- •This invoice constitutes a domestic sale transaction — it is NOT an import invoice
- •Invoices are provided digitally with your order confirmation and can be re-requested by contacting care@crowcrowcrow.com
- •For business/B2B customers: we can issue invoices with your GST number for Input Tax Credit (ITC) purposes upon request at business@crowcrowcrow.com
FEMA Compliance
All transactions comply with the Foreign Exchange Management Act (FEMA) regulations. We import goods commercially for resale, which is a permitted business activity under FEMA.
Legal Distinction: Merchant Import vs. Package Forwarding
It is important to understand the legal difference between our business model and package forwarding services:
- •Merchant Import Model (CrowCrowCrow): Color Papers India Pvt Ltd is the importer of record under the Customs Act, 1962. We hold the IEC, file the Bill of Entry, pay all customs duties and IGST, and bear all regulatory and compliance liability. The sale to you is a domestic transaction under the GST framework. You receive a GST-compliant tax invoice and have full consumer protection rights under the Consumer Protection Act, 2019.
- •Package Forwarding Model (third-party forwarding services): In this model, the end customer is legally the importer. The customer purchases directly from overseas retailers, uses a forwarding address, and is responsible for customs clearance, duty payment, and regulatory compliance. The customer must provide personal KYC documents (such as Aadhaar) to courier companies for customs clearance. No Indian GST invoice is issued, and Input Tax Credit (ITC) is not available. The customer bears all import-related risks including product seizure for non-compliance with BIS or other Indian regulatory requirements.
- •Key legal implications for you: By purchasing from CrowCrowCrow, you are making a domestic purchase from an Indian company. You are not an importer. You have no obligations under the Customs Act. You receive proper tax documentation. Your consumer rights under Indian law are fully preserved.
- •Exception — Products Requiring Additional Documentation: For certain product categories that require additional regulatory documentation or special import clearance, Color Papers India Pvt Ltd may need to process the import under a different importer of record — either the customer or an authorised third-party import partner. In such cases: (a) the customer's Aadhaar card may be required for customs clearance if the customer is designated as the importer; (b) invoice and billing will be adjusted accordingly to reflect the changed import structure; (c) the customer will be informed in advance and their explicit consent will be obtained before proceeding. Additional charges apply only for customised orders or products not originally listed on our website (special sourcing requests). For products already listed on our website, no additional charges apply beyond the displayed price even if the import structure changes. This exception applies only to specific products and will be communicated clearly before purchase.

Product Safety & Recalls
- •If a product sold through our platform is subject to a manufacturer's safety recall, we will make reasonable efforts to notify affected customers via email and/or WhatsApp
- •We will cooperate with any recall process initiated by a brand manufacturer or regulatory authority
- •Customers who have purchased recalled products may be eligible for a full refund or replacement, subject to the manufacturer's recall terms
- •As we are not the manufacturer, we rely on publicly available recall information; there may be delays in notification
Brand IP Notice & Takedown Policy
- •CrowCrowCrow is not an authorised dealer, distributor, or brand representative for any product listed on our platform
- •If any brand owner or authorised representative sends us a valid legal notice regarding intellectual property rights, we will remove the specific product listing(s) (SKU) from our platform
- •Removal applies only to the specific SKU(s) identified in the legal notice
- •Existing confirmed orders for the removed SKU will be fulfilled, but no new orders will be accepted

2B. COUNTRY OF ORIGIN DISCLOSURE
Mandatory Declaration
As required by Consumer Protection (E-Commerce) Rules, 2020, Rule 5(2)(d), we disclose the Country of Origin for all products.

3. ORDER CANCELLATION

- •No forms required—use the cancel button in your dashboard

3.2 Company-Initiated Cancellation
We may cancel orders for:
- •Products prohibited from import in your destination country
- •Items restricted by airline or shipping carrier regulations
- •Customs regulation violations
- •Suspected fraudulent activity
- •Payment failures
When we cancel, you receive full refund within 5-7 business days.
4. PROHIBITED PRODUCTS & IMPORT RESTRICTIONS
4.1 Catalog Accuracy
We make every effort to maintain an accurate product catalog. However, we may inadvertently list products that are prohibited from import in certain countries, restricted by international shipping regulations, or banned by airline cargo policies.
4.2 Right to Cancel
If we discover after order placement that a product cannot be legally shipped to your location due to import prohibitions, shipping carrier restrictions, customs regulations, or international trade restrictions, we will:

- •Remove the product from our catalog
- •Notify you via email within 24-48 hours
- •Issue a full refund to your original payment method within 5-7 business days
4.3 Customer Protection

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, and subject to mandatory consumer protection rights under the Consumer Protection Act, 2019 and other applicable laws that cannot be waived or limited by contract:
For Service-Related Claims:
CrowCrowCrow's total liability for service-related issues (website errors, account access issues, delayed communications, etc.) shall not exceed the lesser of:

- •INR 5,000
11.2 Exclusions from Limitation
This limitation DOES NOT APPLY to and our full liability exists for:
- •Personal injury or death caused by our negligence or the negligence of our employees, agents, or contractors
- •Fraud or fraudulent misrepresentation by CrowCrowCrow or our representatives
- •Gross negligence or willful misconduct by CrowCrowCrow
- •Product defects causing physical harm (governed by Product Liability provisions and Consumer Protection Act)
- •Any liability that cannot be excluded or limited under Indian law, including mandatory consumer protection rights
11.3 Product Defect Liability
For claims related to:
- •Product defects causing injury or property damage
- •Defective products causing consequential losses
- •Safety hazards or dangerous products
Our liability is governed by the Consumer Protection Act, 2019, Sale of Goods Act, 1930, and applicable product liability laws. The INR 5,000 cap DOES NOT apply to such claims.
11.4 Consumer Protection Rights
Nothing in these Terms limits or excludes:

- •Your right to approach Consumer Forums for redressal
- •Your statutory rights under Indian law
- •Manufacturer's warranty obligations
- •Our obligations under E-Commerce Rules, 2020
11.5 Additional Limitations (Where Permitted by Law)
Subject to the above exclusions, we are not liable for:
- •Indirect, incidental, special, or consequential damages
- •Loss of profits, business opportunities, or goodwill
- •Data loss (except as required by data protection laws)
- •Delays or failures due to force majeure or circumstances beyond our control
11.6 Acknowledgment
You acknowledge that:
- •These limitations are reasonable and were a factor in determining the prices we charge
- •Where permitted by law, these limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, etc.)
- •These limitations survive termination of these Terms
11.7 Clarification on Consumer Rights
If you are a "consumer" under the Consumer Protection Act, 2019:
- •You have the right to seek remedies from Consumer Forums
- •Consumer Forums may award compensation beyond these limitations
- •Your statutory consumer rights cannot be waived by contract
- •In case of conflict between these Terms and the Consumer Protection Act, the Consumer Protection Act prevails
12. INDEMNIFICATION
You agree to indemnify and hold CrowCrowCrow harmless from any claims, damages, liabilities, and expenses (including legal fees) arising from:
- •Your use of the Service
- •Your violation of these Terms
- •Your violation of any third-party rights
- •Your fraudulent or illegal activities
- •False return or guarantee claims
13. FORCE MAJEURE
We are not liable for delays or failures in performance caused by circumstances beyond our reasonable control, including natural disasters, wars, government actions, pandemics, strikes, internet failures, shipping carrier delays, or customs delays.
14. DISPUTE RESOLUTION
14.1 Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles. The courts of Thane, Maharashtra, India shall have exclusive jurisdiction for any legal proceedings.
14.2 Informal Resolution (Mandatory First Step)
Before initiating any legal action or formal complaint, you agree to contact us at care@crowcrowcrow.com or grievance@crowcrowcrow.com to seek informal resolution. We will respond within 15 business days and make good-faith efforts to resolve the dispute.
14.3 Consumer Forum (Your Primary Right)
For consumer disputes under the Consumer Protection Act, 2019, you have the right to approach the appropriate Consumer Forum:

For disputes that are NOT consumer disputes under the Consumer Protection Act (e.g., business-to-business transactions, disputes with value above INR 10 Crores), parties may mutually agree to arbitration or mediation.

14.5 No Class Action Waiver
Nothing in these Terms waives your right to:
- •Participate in class actions under Section 2(9) of Consumer Protection Act, 2019
- •Join collective actions or representative proceedings
- •File complaints on behalf of similarly situated consumers
Your rights under the Consumer Protection Act to bring or participate in class actions cannot be waived and remain fully intact.
14.6 Your Rights Are Protected
Important: These dispute resolution terms do not limit your statutory rights. You always have the right to:
- •Approach Consumer Forums at any time
- •File complaints with regulatory authorities
- •Seek injunctions or urgent relief from courts
- •Exercise any other rights under Indian law
14.7 Time Limitation for Claims
Any claim or dispute must be filed within:
- •2 years from the date of purchase (for consumer product complaints)
- •3 years from the date of cause of action (for general contract claims)
- •As specified under applicable limitation laws
15. MODIFICATIONS TO TERMS
15.1 Right to Modify
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website.
15.2 Notification

16.1 Your Right to Terminate
